YOUR INFORMATION RIGHTS
Under the BC Freedom of Information and Protection of Privacy
Act, RSBC 1996, c. 165 hereafter referred to as the "Act", any
person who makes a Freedom of Information (FOI) request has a right
of access to records in the custody or under the control of the
Village of Pemberton, or any other public body. This right of
access does not extend to information which is exempted from
disclosure under Division 2 of the Act. However, if the information
exempted from disclosure can reasonably be severed from a record,
an applicant has the right of access to the remainder of the
record.
If research of the requested record takes in excess of three (3)
hours, the fourth and subsequent hour(s) are subject to the payment
of a fee in accordance with the Schedule of Maximum Fees.
HOW TO MAKE A REQUEST
Required Documents & Info
To obtain access to a record, the applicant must make a Request for Access to Records that:
- Provides sufficient detail to enable to FOI Officer, with a reasonable effort, to identify the records sought;
- Provides written proof of the authority of the applicant to make the request, if the applicant is acting on behalf of another person in accordance with the regulations.
The applicant may ask for a copy of the record, or ask to
examine the record.

OUR DUTY TO ASSIST APPLICANTS
The FOI Officer will provide a letter of confirmation that the request has been received and outline details related to the fee schedule. The FOI Officer will make every reasonable effort to assist applicants and to respond without delay to each applicant openly, accurately and completely.
TIME LIMIT FOR RESPONDING
Subject to sections 7, 23, and 24 of the Act, upon receiving a
FOI request the Village of Pemberton has thirty (30) days in which
to respond.
If on the application, the applicant does not give enough detail
to enable the FOI Officer to identify a requested record, the
Village of Pemberton may extend the time for responding to the
request for up to thirty (30) days.
CONTENTS OF THE RESPONSE
In a response, the FOI Officer must tell the applicant whether or not they are entitled access to the record or to part of the record, and where, when and how access will be given.
